Max V. Kidalov

Mr. Kidalov, NH-IV, is Attorney-Advisor (Contracts) in the Office of General Counsel (Acquisition, Technology and Logistics), U.S. Department of the Air Force (DAF). He provides legal, legislative, and policy advice to the DAF Secretariat, the Air and Space Staffs, Major and Field Commands, and Direct Report Units on small business, innovation, defense industrial base, regulatory relief, and related matters. Mr. Kidalov serves as Legal Counsel to the DAF Office of Small Business Programs (SAF/SB). He assists SAF/SB Director with oversight of Small Business Innovation Research (SBIR), Small Business Technology Transfer (STTR), and all other DAF Small Business Programs and related initiatives, and with resolution of complaints and appeals within SAF/SB's cognizance. Further, Mr. Kidalov represents the DAF in strategic litigation on small business matters before the U.S. Court of Federal Claims and the Government Accountability Office. Mr. Kidalov also represents the DAF on Small Business Teams of the Federal Acquisition Regulation (FAR) and the Defense Acquisition Regulation (DAR) Councils. Mr. Kidalov is a member of the Air Force Board of Correction of Military Records (AFBCMR).

EDUCATION
Mr. Kidalov earned his Master of Laws in Government Procurement Law from the George Washington University. Mr. Kidalov earned his Juris Doctorate and Bachelor of Science in Business Economics & Finance, Cum Laude, from the University of South Carolina.

PROFESSIONAL EXPERIENCE
Mr. Kidalov is an attorney with over 20 years of extensive experience with the Federal Government and the defense industry. He is admitted to the bars of the Supreme Court of South Carolina, the U.S. Court of Federal Claims, and the U.S. Court of Appeals for the Federal Circuit.

Mr. Kidalov is a member of the U.S. Department of Defense civilian service, with career experience as attorney-advisor (contracts) at the Air Force Office of General Counsel and as assistant professor of procurement law and policy at the Naval Postgraduate School. At NPS, Mr. Kidalov supported the Secretary of the Navy’s Office of Small Business Programs, the National Procurement Fraud Task Force, the Multi-National Security Transition Command-Iraq, and NATO initiatives such as Partnership for Peace and Building Integrity in Defense, including via multiple deployments to overseas contingency operation areas.

Mr. Kidalov also advised Executive agencies and Congress through Federal advisory committees. He was a member and, later, a reference advisor to a member, of the Interagency Task Force on Veterans Small Business Development (IATF), U.S. Small Business Administration. He was also a member of the Small Business Advisory Council, U.S. Department of Energy.

In the Legislative Branch, Mr. Kidalov was a member of the U.S. Senate staff. He was counsel for procurement, innovation, and oversight matters at the Committee on Small Business and Entrepreneurship. Mr. Kidalov also served as law clerk at the Judiciary Committee’s office of former Chairman. Additionally, Mr. Kidalov served as law clerk to Chief (now Senior) Judge Loren A. Smith at the U.S. Court of Federal Claims. In the private sector, Mr. Kidalov served as vice president and general counsel for a 400-person government contractor firm, as a small business contractors’ trade association executive, and as an attorney with law and government relations firms.

Mr. Kidalov has published in leading legal and public procurement journals and periodicals on bid protests, contract disputes, takings, and other Federal claims. As a legal academic, he has authored, co-authored, and supervised numerous research studies and reports on U.S. and international small business procurement, defense industrial base, and innovation law and policy. Mr. Kidalov is former vice chairman of Bid Protest and Small Business Committees, American Bar Association (ABA) Section of Public Contract Law.
